Agreement to Terms
By using the hambeacon.com website or the HamBeacon app, you agree to these Terms of Service. If you do not agree, please do not use the website or the app.
About HamBeacon
HamBeacon is a native Apple app that helps you prepare for the United States amateur radio license exams. It covers all three license classes, the Technician, General, and Amateur Extra elements, using the current question pools published by the National Conference of Volunteer Examiner Coordinators (NCVEC) together with a spaced repetition study system. HamBeacon is published by Blue Heron Data and is distributed through the Apple App Store. The hambeacon.com website promotes the app and provides support and policy information.
HamBeacon Is a Study Aid
HamBeacon is an independent study aid. It is not affiliated with the FCC, the NCVEC, the ARRL, or any Volunteer Examiner Coordinator. The questions in the app come from the official NCVEC question pools, which are in the public domain. While HamBeacon is designed to prepare you thoroughly, we cannot and do not guarantee that you will pass any examination. Your result depends on your own study, the questions on your exam, and the examination itself.
Purchases
HamBeacon is a one-time purchase with no subscriptions. You buy a single license class or the All Access Bundle, and a purchase covers your Apple devices under the same Apple ID, with Apple Family Sharing supported. All purchases are made through the Apple App Store and are handled by Apple under Apple’s terms. Refunds and billing are managed by Apple, not by Blue Heron Data. When the NCVEC publishes a new question pool for a class you own, the updated pool is provided as a free app update.
Intellectual Property
The HamBeacon app and the hambeacon.com website, including their design, code, text, graphics, and branding, are the property of Blue Heron Data and are protected by copyright. The NCVEC question pools themselves are in the public domain and are reproduced unmodified. You may not copy, modify, distribute, reverse engineer, or create derivative works from the app or the website, except as permitted by the app’s standard license terms or by law.
Third-Party Services
The website and the app rely on services provided by others, including Apple for app distribution, purchases, and iCloud sync, Hostinger for website hosting, and CookieYes for cookie consent. We are not responsible for the availability or practices of these services, and your use of features that depend on them is subject to their own terms.
Disclaimer of Warranties
The HamBeacon app and the hambeacon.com website are provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not warrant that the app or the site will be uninterrupted, secure, or error free, that any study result or readiness number will be accurate for your situation, or that the app will be suitable for any particular purpose. Readiness and practice exam scores are estimates of your preparation, not predictions of your exam result.
Limitation of Liability
To the fullest extent permitted by law, Blue Heron Data will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the app or the website, including loss of data or loss of time. Our total liability for any claim relating to the app will not exceed the amount you paid for it.
Indemnification
You agree to hold harmless Blue Heron Data from any claims, damages, losses, or expenses, including reasonable legal fees, arising from your use of the app or the website or from your violation of these terms.
Modifications to the App and the Website
We may update, change, or discontinue any part of the app or the website at any time. We are not liable to you or to anyone else for any change, suspension, or discontinuation.
Changes to These Terms
We may update these Terms of Service from time to time. Any changes will be posted on this page with a new effective date. Continuing to use the app or the website after changes are posted means you accept the revised terms.
Governing Law
These Terms of Service are governed by the laws of the United States. Any dispute arising from these terms or from your use of the app or the website will be resolved under applicable federal and state law.
Severability
If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
